Given your theory, Brian, is it possibly a nut allergy? Not even "accidental" poison but just cross contamination from a facility that also processes nuts?

When I saw the first episode, I immediately predicted that Ben's attempted murder and Ben's actual murder would be caused by two different people, so there'd be two culprits.
At this point, I agree that it's possible that nobody poisoned Ben, or that him being poisoned was an accident (maybe the rat poison ended up on the cookies). However I really don't think that he died by accident, there is no way you fall down an elevator shaft in a fancy building by accident. Somebody had to deliberately open the elevator doors on a higher floor (the cops or the main characters really should have examined each door to see if there was any sign any had been forced open) and throw his body down there. I too am currently leaning towards Tobert, Dickie is also possible but he seems almost too obvious.
